1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of rus.sh (the "Service"), operated by rus.sh Inc. ("we," "us," or "our"). By creating an account or using any part of the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Service Description

rus.sh provides URL shortening, link management, analytics, and related services including but not limited to:

• Short URL creation and management
• Custom domain support
• Click tracking and analytics
• QR code generation
• Digital vCard creation
• Metadata relay and link customization
• API access (on applicable plans)

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts

Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities under your account

Account Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18, you must have permission from a parent or guardian.

Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms, without prior notice.

4. Acceptable Use Policy

You agree not to use the Service to:

• Illegal Activities: Violate any laws or regulations
• Malicious Content: Distribute malware, viruses, or harmful code
• Spam: Send unsolicited bulk messages or spam
• Phishing: Impersonate others or engage in deceptive practices
• Adult Content: Share pornographic or sexually explicit material
• Hate Speech: Promote violence, discrimination, or harassment
• Copyright Infringement: Violate intellectual property rights
• System Abuse: Attempt to circumvent security measures or overload our systems
• Misleading Links: Use link cloaking to deceive users about destinations

We reserve the right to review any shortened URLs and remove or disable links that violate this policy. Repeated violations may result in account termination.

5. Payment and Billing

Paid Plans

Certain features of the Service require a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your chosen plan
• Provide accurate billing information
• Authorize automatic recurring charges
• Update payment information as needed

Billing Cycles

Subscriptions are billed in advance on a monthly or annual basis, depending on your chosen plan. Your subscription will automatically renew unless canceled before the renewal date.

Refunds

We offer a 14-day money-back guarantee for new subscriptions. After 14 days, payments are non-refundable. Refunds for annual plans are prorated.

Changes to Pricing

We may change our pricing with 30 days' notice. Price changes will apply to your next billing cycle.

6. Intellectual Property

Our Rights

The Service, including all content, features, and functionality, is owned by rus.sh Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

Your Content

You retain all rights to the content you submit to the Service (destination URLs, custom slugs, metadata, etc.). However, you grant us a license to use, store, and display your content as necessary to provide the Service.

Trademarks

"rus.sh" and our logo are trademarks of rus.sh Inc. You may not use our trademarks without prior written permission.

7. Content and Conduct

You are responsible for all content you create or share through the Service:

• Destination URLs: Ensure all destination URLs comply with these Terms
• Custom Slugs: Do not use trademarked or offensive slugs
• Metadata: Do not use misleading or deceptive metadata
• QR Codes: Ensure QR codes link to appropriate content

We may review and remove content that violates these Terms, but we are not obligated to monitor all user content.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

9. Service Availability

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted access to the Service. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Third-party service disruptions
• Force majeure events

We are not liable for any damages resulting from service interruptions or downtime.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind, express or implied
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim
• We are not responsible for content accessed through shortened URLs or actions taken based on analytics data

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless rus.sh Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you create or share through the Service

12. Termination

By You

You may cancel your account at any time through your account settings. Upon cancellation:

• Your subscription will not renew
• You will retain access until the end of your billing period
• Your short links will continue to work for 30 days
• After 30 days, your data may be permanently deleted

By Us

We may terminate your account immediately if:

• You violate these Terms or our Acceptable Use Policy
• Your account is inactive for 12+ months (free plans)
• You fail to pay subscription fees
• We are required to do so by law

Effect of Termination

Upon termination:

• Your access to the Service will end
• All short links may stop working immediately
• We may delete your data, subject to legal requirements
• Sections that should survive termination will remain in effect

13. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via email (for paid accounts)
• Display a notice in your dashboard

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service.

14. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through:

1. Informal Resolution: Contact us at legal@rus.sh to attempt to resolve the dispute
2. Binding Arbitration: If informal resolution fails, the dispute will be resolved through binding arbitration under the American Arbitration Association rules
3. Class Action Waiver: You agree not to participate in any class action lawsuits

Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.
